Act 38-2026 — filing deadline

Applications filed by 31 December 2026 keep the 0% rate.

Act 38-2026 extended Puerto Rico's Individual Resident Investor programme through 2055, but tightened the terms for anyone applying from 1 January 2027. What fixes your position is the date your application is submitted — not the date your decree is granted. An application filed in time keeps the current treatment even if the decree itself arrives the following year.

The opportunity

What is Act 60?

Act 60 consolidates Puerto Rico’s tax incentives into a single code: qualifying new residents may pay 0% Puerto Rico tax on certain capital gains, dividends, and interest, and a 4% rate on eligible export-services income. In exchange, you become a bona fide resident — genuinely present on the island, invested in its community, and the owner of a home here within two years.
